Welcome to Silver Peak Media, operated by Veteran Projects LLC. These Terms of Service ("Terms") govern your use of our website and photography services. By booking a session, using our website, or engaging with our services, you agree to these Terms.

If you do not agree, please do not use our services.

1. Services Provided

Silver Peak Media specializes in real estate photography serving the Las Vegas, Nevada area. Our services include:

  • Interior and exterior property photography

  • Twilight and drone photography (where applicable and legally permitted)

  • Virtual staging and photo editing

  • Video tours and walkthroughs

  • Floor plans and 3D tours (as available)

Specific deliverables, timelines, and pricing are outlined in your individual booking confirmation or service agreement.

2. Booking and Scheduling

Booking Process

  • All bookings must be confirmed via email, phone (702-518-8187), or through our website booking system

  • A deposit or full payment may be required to secure your appointment

  • Booking confirmation will include shoot date, time, property address, and service details

Rescheduling

  • Clients may reschedule up to 24 hours before the scheduled shoot time without penalty

  • Rescheduling requests made less than 24 hours in advance may incur a rescheduling fee or forfeiture of deposit

Cancellations

  • Cancellations made 48 hours or more before the shoot will receive a full refund minus a processing fee

  • Cancellations made less than 48 hours before the shoot will forfeit the deposit or be charged 50% of the total service fee

  • Same-day cancellations or no-shows will be charged the full service fee

Weather and Unforeseen Circumstances

  • If weather conditions make photography unsafe or unsuitable (heavy rain, extreme winds, poor visibility), we reserve the right to reschedule at no additional charge

  • In the event of emergencies, natural disasters, or other circumstances beyond our control, we will work with you to reschedule at the earliest opportunity

3. Payment Terms

Pricing

  • All pricing is provided in writing via quote, booking confirmation, or published rate sheet

  • Prices are subject to change but will be honored for confirmed bookings

  • Additional services requested during or after the shoot may incur extra fees

Payment Methods

  • We accept credit cards, debit cards, PayPal, Venmo, Zelle, and checks

  • Payment is due in full before photos are delivered unless otherwise agreed upon in writing

Late Payments

  • Invoices not paid within 30 days of the due date may incur a late fee of 1.5% per month (or the maximum allowed by Nevada law)

  • Photos will not be delivered until payment is received in full

Refunds

  • Refunds are handled on a case-by-case basis and are subject to our cancellation policy

  • If we are unable to fulfill the service due to our error, a full refund will be provided

4. Client Responsibilities

To ensure a successful shoot, clients agree to:

Property Access

  • Provide full access to the property at the scheduled time

  • Ensure the property is clean, staged, and ready for photography

  • Remove or secure pets during the shoot

  • Turn on all lights and open blinds/curtains as instructed

Accuracy of Information

  • Provide accurate property addresses, access codes, lockbox information, and contact details

  • Notify us immediately of any changes to the shoot location or requirements

Safety and Liability

  • Ensure the property is safe for our team to enter and photograph

  • Notify us of any hazards (unstable flooring, exposed wiring, aggressive animals, etc.)

  • We are not responsible for injury or damage caused by unsafe property conditions

5. Copyright and Ownership

Copyright Ownership

  • Silver Peak Media retains full copyright of all photographs taken during the shoot

  • Clients receive a non-exclusive, perpetual license to use the images for real estate marketing purposes as outlined in Section 6

Editing and Alterations

  • We will provide professionally edited, high-resolution images

  • Clients may not alter, crop, filter, or edit images in a way that misrepresents the property or degrades image quality without our written permission

  • Removing watermarks or copyright information is strictly prohibited

6. Image Usage and Licensing

Permitted Use

Clients are granted a license to use the images for:

  • MLS listings and real estate marketing platforms (Zillow, Realtor.com, etc.)

  • Real estate agent websites, social media, and advertising materials

  • Print marketing (flyers, brochures, postcards)

  • Internal business use (presentations, portfolios)

Prohibited Use

Clients may not:

  • Sell, transfer, or sublicense the images to third parties

  • Use images for purposes unrelated to real estate marketing without written permission

  • Claim ownership or authorship of the images

  • Use images in a way that violates copyright law or misrepresents the property

Portfolio and Marketing Use

  • Silver Peak Media reserves the right to use images in our portfolio, website, social media, advertising, and promotional materials

  • If you prefer your images not be used publicly, please notify us in writing at the time of booking

7. Image Delivery and Storage

Delivery Timeline

  • Photos will be delivered within 24-48 hours of the shoot via Dropbox or Google Drive link

  • Rush delivery may be available for an additional fee

File Format

  • Images are delivered as high-resolution JPEGs optimized for web and print use

  • Raw files are not included unless specifically contracted and paid for

Storage and Backup

  • We retain a backup copy of your images for 90 days after delivery

  • After 90 days, images may be permanently deleted from our storage systems

  • Clients are responsible for downloading and backing up their images

Re-Delivery

  • If you lose your images within 90 days, we can re-send them at no charge

  • Re-delivery requests after 90 days may incur a file retrieval fee or may not be possible

8. Liability and Warranties

Quality Assurance

  • We strive to deliver high-quality images that accurately represent the property

  • If you are unsatisfied with the final images, notify us within 7 days of delivery, and we will work with you to address concerns

No Guarantees

  • We do not guarantee specific outcomes, sales results, or listing performance based on our images

  • Photography is a creative service, and results may vary based on property conditions, lighting, weather, and other factors

Limitation of Liability

  • Our total liability for any claim related to our services shall not exceed the amount paid for the specific service in question

  • We are not liable for indirect, incidental, or consequential damages including lost profits, lost sales, or business interruptions

Indemnification

  • Clients agree to indemnify and hold harmless Silver Peak Media and Veteran Projects LLC from any claims, damages, or legal actions arising from the client's use of the images

9. Drone and Aerial Photography

Compliance with Laws

  • All drone operations are conducted in compliance with FAA regulations and local Nevada laws

  • We are licensed and insured for commercial drone operations

Weather and Airspace Restrictions

  • Drone shoots are subject to favorable weather conditions and airspace restrictions

  • If drone photography cannot be safely or legally completed, we will offer alternatives or partial refunds as appropriate

Client Permissions

  • Clients are responsible for obtaining any necessary permissions from property owners, HOAs, or local authorities for drone photography

10. Privacy and Data Protection

Your personal information is handled in accordance with our [Privacy Policy]. By using our services, you agree to the collection and use of information as described.

11. Intellectual Property

Trademarks

  • "Silver Peak Media" and any associated logos or branding are the property of Veteran Projects LLC

  • Clients may not use our name, logo, or branding without written permission

Website Content

  • All content on our website (text, images, graphics, design) is protected by copyright and may not be reproduced without permission

12. Dispute Resolution

Governing Law

  • These Terms are governed by the laws of the State of Nevada

  • Any legal disputes will be resolved in the courts of Clark County, Nevada

Mediation and Arbitration

  • In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation

  • If negotiation fails, disputes may be resolved through mediation or binding arbitration in Las Vegas, Nevada

13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, along with any signed service agreements or booking confirmations, constitute the entire agreement between you and Silver Peak Media. Any prior agreements, understandings, or representations are superseded by these Terms.
