Copyright & Image Usage Agreement

This Copyright & Image Usage Agreement ("Agreement") governs the use of photographs created by Silver Peak Media, operated by Veteran Projects LLC ("Photographer," "we," "us," or "our"). By purchasing, licensing, or using our images, you ("Client," "you," or "your") agree to the terms outlined below.

1. Copyright Ownership

Photographer Retains Copyright

  • Silver Peak Media retains full and exclusive copyright to all photographs created during any photography session or project

  • Copyright protection applies to all images, whether edited, unedited, or in raw format

  • Copyright ownership cannot be transferred, sold, or assigned unless explicitly stated in a separate written agreement signed by both parties

Legal Protection

  • All images are protected under U.S. Copyright Law (Title 17, U.S. Code)

  • Unauthorized use, reproduction, or distribution of images is a violation of federal law and may result in legal action

  • Copyright notice may be embedded in image metadata and should not be removed

2. Client License Grant

Non-Exclusive License

Upon full payment, Client receives a non-exclusive, non-transferable, perpetual license to use the licensed images for the purposes outlined in this Agreement.

This license includes the right to:

  • Display images on MLS platforms (Zillow, Realtor.com, Trulia, etc.)

  • Use images on real estate agent websites and social media accounts

  • Print images for marketing materials (brochures, flyers, postcards, signage)

  • Share images with clients, property owners, and relevant parties for real estate marketing purposes

  • Use images in digital advertising and email marketing campaigns related to the property

License Limitations

This license does NOT include the right to:

  • Sell, sublicense, or transfer images to third parties for compensation

  • Claim authorship or ownership of the images

  • Use images for purposes unrelated to real estate marketing without written permission

  • Alter, edit, crop, or manipulate images in a way that misrepresents the property or degrades quality

  • Remove watermarks, copyright information, or embedded metadata

  • Use images in defamatory, illegal, or unethical contexts

3. Permitted Uses

Real Estate Marketing

Images may be used for:

  • Active property listings on all major real estate platforms

  • Agent websites, blogs, and portfolios

  • Social media posts promoting the property or agent's services

  • Print advertising (magazines, newspapers, direct mail)

  • Open house materials and signage

  • Internal presentations and client communications

Extended Marketing

After a property is sold or leased:

  • Images may continue to be used in the listing agent's portfolio and marketing materials

  • Images may be used to showcase past sales and market expertise

  • Property-specific images should be removed from active listings once the property is no longer available

Commercial Use Beyond Real Estate

If Client wishes to use images for purposes beyond standard real estate marketing (such as commercial advertising, editorial publications, or product promotions), written permission must be obtained and additional licensing fees may apply.

4. Prohibited Uses

Strictly Forbidden

Clients may NOT:

  • Resell or relicense images to other photographers, agents, or third parties

  • Transfer ownership of images to buyers, sellers, or other parties

  • Submit images to stock photography sites or other image libraries

  • Use images in a misleading way (e.g., representing a different property, false advertising)

  • Claim creation or copyright of the images

  • Remove or obscure photographer credits, watermarks, or metadata

  • Create derivative works (heavy alterations, artistic filters, composite images) without permission

  • Use images beyond the licensed scope (e.g., using real estate photos for unrelated commercial products)

Alterations and Editing

  • Minor adjustments (brightness, contrast, cropping for platform requirements) are permitted

  • Substantial edits, filters, overlays, or manipulations that change the integrity of the image are prohibited without written consent

  • AI-generated alterations or enhancements require prior approval

5. Image Delivery and File Formats

Delivery Method

  • Images are delivered via Google Drive or Dropbox link within 24-48 hours of the shoot

  • High-resolution JPEG files optimized for web and print are provided

  • Raw files are NOT included unless separately contracted and paid for

File Ownership

  • Client receives a copy of edited images for use under this license

  • Photographer retains master files, raw images, and backups

  • Re-delivery of images may be available within 90 days at no charge; after that, a retrieval fee may apply

6. Attribution and Credit

Photographer Credit

While not required, we greatly appreciate credit when images are shared publicly:

  • Suggested credit: "Photos by Silver Peak Media" or "@silverpeakmedia"

  • Credit may be included in MLS listings, social media captions, or print materials

Portfolio and Marketing Use by Photographer

Silver Peak Media reserves the right to:

  • Use images in our portfolio, website, and social media

  • Feature images in promotional materials and advertising

  • Submit images to industry publications or competitions

  • Display images at trade shows or professional events

Opt-Out Available: If you prefer your images not be used in our public marketing, please notify us in writing at the time of booking.

7. Third-Party Use and Sharing

Authorized Sharing

Clients may share images with:

  • Property owners or sellers (for listing approval and marketing)

  • Buyers or potential buyers (as part of the sales process)

  • Real estate team members, brokerages, and collaborators

  • Media outlets or publications (with proper photographer credit)

Unauthorized Sharing

Clients are responsible for ensuring that anyone they share images with complies with this Agreement. If a third party misuses images, Client may be held liable.

8. Image Modifications and Enhancements

Permitted Adjustments

Clients may make minor adjustments for platform compatibility:

  • Cropping to fit specific dimensions (Instagram square, MLS requirements, etc.)

  • Minor brightness/contrast adjustments

  • Resizing for web or email use

Prohibited Modifications

Clients may NOT:

  • Apply heavy filters or artistic effects

  • Add or remove elements from the image (virtual staging beyond what was contracted)

  • Combine images into composites without permission

  • Use AI tools to alter, enhance, or manipulate images beyond basic corrections

  • Distort or misrepresent the property in any way

If additional editing or alterations are needed, contact us to discuss options and potential fees.

9. Expiration and Termination

Perpetual License

This license is perpetual and does not expire as long as:

  • Payment has been made in full

  • Client remains in compliance with this Agreement

Termination for Breach

If Client violates the terms of this Agreement:

  • Photographer may terminate the license immediately

  • Client must cease all use of the images

  • Photographer may pursue legal remedies including damages and injunctive relief

10. Enforcement and Legal Remedies

Copyright Infringement

Unauthorized use of images is a violation of U.S. Copyright Law and may result in:

  • Cease and desist demands

  • Removal of images from websites and platforms

  • Monetary damages (statutory damages up to $150,000 per infringement under federal law)

  • Attorney's fees and legal costs

  • Injunctive relief to prevent further misuse

DMCA Takedown Notices

If images are used without authorization, we reserve the right to file DMCA takedown notices with hosting platforms, social media sites, and search engines.

Dispute Resolution

Any disputes arising from this Agreement will be resolved under the laws of Nevada and in the courts of Clark County, Nevada.

11. Indemnification

Client agrees to indemnify and hold harmless Silver Peak Media and Veteran Projects LLC from any claims, damages, losses, or legal fees arising from:

  • Misuse of images by Client or third parties

  • Violation of this Agreement

  • Unauthorized alterations or distribution of images

12. Limitation of Liability

No Guarantees

While we strive to deliver high-quality images:

  • We do not guarantee specific sales results, listing performance, or business outcomes

  • Photography results depend on property conditions, lighting, and other uncontrollable factors

Liability Cap

Our total liability for any claim related to the images shall not exceed the total amount paid by Client for the photography services.

13. Revisions to This Agreement

We reserve the right to update this Agreement at any time. Changes will be posted on our website with an updated "Last Updated" date. Continued use of images after changes constitutes acceptance of the revised terms.

For services already contracted prior to a change, the terms in effect at the time of booking will apply.

14. Entire Agreement

This Copyright & Image Usage Agreement, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between Client and Silver Peak Media regarding the use of images.

Any additional terms or modifications must be made in writing and signed by both parties.

15. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
